This entire website, and its subordinate websites (the Arner Website, the Orner Website, etc), and every contained individual web page are each copyrighted as a whole.
As a general rule, publicly available facts, public information, and extracted lists of public information are not copyrightable. However, value added by the author (editorial content, specific formatting of information, indexes, cross-references, etc) is copyrightable. In accordance with that (and with the fact that the only reason I created this site in the first place was so that researchers could easily find and use the included information), the following restrictions also apply to this website:
Each webpage on this website is copyrighted, as a whole.
The publicly available facts (names, dates, places, etc) on the genealogical webpages are not copyrighted.
The included “Notes” and other editorial content on each genealogical webpage that were added by the author are copyrighted.
All of the indexes and cross-referenced extract lists on this website, as published, are each copyrighted as a whole [the added hyperlinks, etc are value added by the author].
All direct descendants and related researchers of any of these families are authorized to:
Extract any or all of the publicly available information from any of the webpages on this website, only for the personal use of themselves and/or other direct descendants of these families.
Download any webpages on this website to their own computer, and/or make copies of any webpages on this website, only for their own personal use and/or for the personal use of other direct descendants of these families, and only as long as any such copies include the copyright notice at the bottom of each page.
Send private copies of any webpage on this website to any other direct descendant of these families, for that person’s own personal use only, and only as long as all such copies include the copyright notice at the bottom of each page.
The following activities are strictly prohibited:
Publishing copies of this website, or of any of the individual pages on this website, in any public venue including, but not necessarily limited to: other websites, public message boards, public mailing lists, television shows, books, magazines, newspapers, and newsletters.
Using the information on this website for any commercial purpose, to include including said information in any publication offered for sale, regardless of whether that publication results in any net profit for that publication’s author or publisher.
Important Note about photographs:
All of the photographs on this website were taken by me (Joseph Erner), unless noted otherwise.
All of the photographs are copyrighted by the photographer who took each photo. However, unlimited reproduction rights for personal use only are hereby granted to all descendants of families on this website that are pertinent to that specific photo. (For example, if I have posted a photo of someone’s gravestone, these unlimited rights are granted only to descendants of that person and to descendants of that person’s brothers and sisters, and their spouses.) Selling copies of the photos, or any other commercial use of them, is strictly prohibited without written permission from the photographer.
Limited reproduction rights will normally be granted to other historians, genealogical researchers, etc upon request. For example, if your ancestors attended the same church, and you’d like to post a copy of my photo of that church on a personal (but not commercial) website, that will usually be okay; just contact me. If you link to one or more of my Church Pages instead, let me know, and I’ll normally put in a link or links to your website also (unless it is invitation-only, or requires a password, etc).
All rights to this website, and to any portion of this website, except those specifically disallowed by law, are strictly reserved to the author, Joseph Erner.
